A 25% deposit must be paid to 'MUZIQUE' within 14 days after receiving the confirmation letter, along with a signed contract to secure the booking. This deposit is non-refundable after 14 days.
All balances outstanding must be settled either by cheque - cash - bank draft within 14 days of the event. Failure to adhere to this will result in the booking becoming null and void.
If for any reason the 'client' wishes to cancel the booking, a 50% refund will be given as long as the cancellation is not within 30 days of the event.
If the cancellation is because the 'client' has not met the requirements of the terms and conditions within this agreement, no refund will be given.
In the unlikely event of 'MUZIQUE' not attending the event due to circumstances caused or otherwise caused by the 'client' or the 'venue' no monies shall be refunded.
If additional performance time is required, this fee must be arranged and paid to 'MUZIQUE' at that time. No extra time will be considered without payment being forthcoming from the 'client' or the 'venue'.
The 'client' shall at all times, have complete supervision, direction and control of the services provided by this agreement and the ends to be accomplished as long as they are in keeping with accepted professional practices and equipment capabilities.
The 'client' will allow suitable time for the installation and dismantling, and removal of equipment (normally one hour). Where appropriate, the 'client' will arrange with the 'venue', suitable time to allow installation and dismantling, and removal of the equipment (normally one hour).
'MUZIQUE' will ensure that any equipment to be connected to a power supply is electrically safe, has passed PAT electrical safety testing, and confirms to the HSE EAW Act 1989, and any subsequent amendments.
The 'client' is responsible for any damage, loss, misuse, or theft of any equipment (including vehicles being stored at the 'venue' belonging to 'MUZIQUE', caused by anyone other than members of 'MUZIQUE' with malicious intent .
It is the 'clients' responsibility to ensure the venue has adequate security for persons and equipment of 'MUZIQUE'.
'MUZIQUE' will not be held responsible for damage to the 'venue' caused by the company's equipment or misuse or damage of it by another person or animal.
The 'client' is required to make sure the 'venue' complies with all Health & Safety issues.
All venues are visited in advance to ensure adequate power supplies are available, and to determine the best position for the equipment and to arrange access etc. with the 'venue' management. It is ultimately the 'clients' responsibility to ensure that enough power and space are available and 'MUZIQUE' cannot be held responsible for any lack of power supply, insufficient space within which to set up or other facilities not under it's control, which will be detrimental to carrying out the engagement. Power must be available to the area in which the equipment will be set up, or just adjacent. This means at least 3 or more preferably 4 13Amp sockets will be available for sole use by 'MUZIQUE'. In marquees, 2 or preferably 3 13 Amp sockets must be no more than 10 metres away from the power source being run by the 'client' or the 'client's agent'. 'MUZIQUE' will not be required to supply cable and trunking over and above these specifications without reasonable notice and financial recompense.
'MUZIQUE' will not be held responsible for the injury to the 'clients' guests or the 'client's guests' children who interfere with the equipment in any way.
'MUZIQUE' will endeavour not to play any song's that may cause offence, other than when requested by the 'client'. It is the 'hirers' responsibility to ensure that their guests are aware that songs containing parental advisory lyrics may be played after a certain time - this being a watershed agreed by both parties.
'MUZIQUE' shall not be liable for breaches of byelaws and/or conditions under which the 'venue' is entrusted, hired or leased to the 'client'. The 'client' will ensure all appropriate licences (as required by law) are in force at the venue at the time of the event, therefore 'MUZIQUE' cannot be held liable.
